ServiceStar Directories Site Terms & Conditions 

1.        The servicestar.com.au website is operated by ServiceStar Directories. ServiceStar Directories is a registered trading name of Terringal Pty Ltd., ACN 001 827 569.

2.        The ServiceStar logo is a trade mark of Terringal Pty Ltd 

3.        Users of this web site agree to be bound by these terms and conditions. 

4.        Users will not use this site for any purpose or in any way which is contrary to these terms and conditions or which is unlawful.

5.        ServiceStar Directories gives no guarantee of continued availability of any particular product or service offered by businesses on this web site. 

6.        All intellectual property in relation to material included on the ServiceStar Directories site belongs to ServiceStar Directories or its listed Members. Users may not do anything which interferes with or breaches those intellectual property rights. 

7.        The information contained on the site is provided by ServiceStar or its listed Members. It does not purport to be comprehensive. 

8.        Neither ServiceStar Directories nor the listed Members give any guarantees, undertakings or warranties concerning the accuracy, completeness or up to date nature of the information provided nor its suitability for a particular purpose of the user. 

9.        ServiceStar Directories will not be liable for any loss or damages (including direct, indirect, consequential, incidental and exemplary): 

·          if this site is unavailable to users (by virtue of interruption, suspension or termination) for any reason, including due to computer or communications link downtime attributable to malfunction, upgrades or preventative or remedial maintenance activities;

·          if there is a deficiency or inaccuracy in the site attributable to a lack of maintenance of the site;

·          in relation to a notice or advertisement not appearing in accordance with instructions;

·          in relation to a person's reliance on information contained on the site;

·          in relation to the correctness, accuracy, currency, completeness or otherwise of information contained on the site; or

·          in relation to the supply of services or products on or in relation to this site.  

10.     On using this site and its services, users indemnify ServiceStar Directories, its directors, employees and agents against any claim, demand, injury, direct or indirect damage, loss or cost, liability, right of action or claim for compensation in contract, under statue or in tort (including negligence) made against or suffered by any of those indemnified arising, in whole or in part, in relation to: 

·          any activity that is expressed in these terms and conditions to be the responsibility of the User;

·          any advertisement placed on the site or information made available on the site; or

·          a breach of these terms and conditions. 

11.     Without limiting the application of paragraph 10, users shall indemnify ServiceStar Directories, its directors, employees and agents in relation to defamation, liable, slander of title, infringement of copyright, infringement of trademarks or names of publication titles, unfair competition, breach of Trade Practices or Fair Trading legislation, violations of rights of privacy, confidential information, licences, loyalty rights or other intellectual property rights. 

12.     These terms and conditions are subject to change at the sole discretion of ServiceStar Directories. 

13.     Users acknowledge that all correspondence concluded on the ServiceStar Directories site and all activities of ServiceStar Directories are made and concluded in New South Wales, Australia. 

14.     These terms and conditions shall be governed by the laws of the state of New South Wales, Australia. The parties agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction there. 

15.     For the purposes of these terms and conditions: 

·          ServiceStar Directories means Terringal Pty Ltd and each of its directors, employees and agents. 

·          Users means all users of the website, including consumers and Members. 

·         Members means businesses which are listed in the ServiceStar on-line directory.
